The Communication Commission of the House of Representatives approved this week a bill that establishes administrative punishments for people who practice graffiti. Among the expected measures are the suspension of the National Driver’s License (CNH) and the block for six months of all telephone lines recorded in the name of the offender.
Authored by Deputy Bibo Nunes (PL-RS), Bill 337/24 also prohibits that the graffiti authors have access to loans with public subsidies, such as payroll funding. In case of recurrence, the predicted penalties will be applied double. The blockade of the telephone lines will be up to the operators, based on the offender’s CPF.
The proposal now follows for analysis, on a conclusive basis, in the Traffic and Transport and Constitution and Justice and Citizenship committees. If approved, it will be sent to the Senate.
The text defines graffiti such as the act of scratching, drawing, writing, staining or dirty buildings, urban furniture or public and private equipment, without proper authorization from the owner.
The rapporteur of the proposal, Deputy Silvye Alves (União-GO), defended the approval of the bill as a way to contain the advance of practice. “Picking is already an environmental crime, but current punishments were not enough to contain the problem. It is necessary to go further,” he argued.
For the parliamentarian, the proposed restrictions may have a direct impact on the daily life of offenders. “These are measures that generate practical consequences, which can be more effective than just fines or symbolic penalties.”
Compensation
The project also provides that administrative sanctions are applied regardless of any criminal sanctions and the obligation to indemnify the damages caused. If the offender does not pay compensation for material or moral damages, the amount will be registered in active debt.
The proposal will also undergo two commissions before going to the Senate vote. If approved by the two houses, it will go to presidential sanction.
