STF listens to Bolsonaro’s last witness on Monday

With the testimony of Senator and former Minister Rogério Marinho (PL-RN) on Monday, the first class of the Supreme Court (STF) is expected to finish on Monday the hearing of all witnesses of the coup plot. Marinho was called to testify for the defenses of former President Jair Bolsonaro (PL) and former Minister Walter Braga Netto.

With the end of the witnesses ‘testimonials, the process will move to a new phase, when the defendants’ interrogations will be marked. In the case of the main action on the attempted coup, there are eight defendants: former ministers Walter Braga Netto, Augusto Heleno, Anderson Torres and Paulo Sérgio Nogueira, former Navy Commander Almir Garnier Santos, Federal Deputy and former director of the Brazilian Intelligence Agency (Abin), Alexandre Ramagem, former President of Orders, the former president of the former president, Jair Bolsonaro.

In the current phase of the process, called instruction, defenses may also require the production of new evidence, such as expertise, as well as presenting new evidence to the process or requesting complementary actions on facts already investigated by the Federal Police (PF). It is up to the rapporteur of the case, Minister Alexandre de Moraes, to accept or not the claims of the defenses.

With the completion of this process, Moraes must schedule the interrogation of the defendants. In the case of this criminal action, as one of the accused, Lieutenant Colonel Mauro Cid, signed a collaboration agreement with the investigation, he will necessarily be the first to testify. This is because, in criminal action, defenses must have the opportunity to defend themselves from all accusations.

Similarly, all defendants have the right to remain silent during their interrogation since no accused is obliged to produce proof against himself.

Finished the interrogations, Minister Alexandre de Moraes will again open a deadline for accusation and defenses to position themselves in the process, for the so -called final allegations. Again, due to the denunciation signed by Mauro Cid, the order of presentation must favor the defenses: with this, the Attorney General’s Office (PGR) will present its final arguments, followed by the former Assistant of Orders and, finally, by all defendants’ defenses.

This is the last phase of the case before the trial, which will be carried out with the reading of the report by Minister Alexandre de Moraes, in addition to his vote and the other four members of the class, Ministers Flávio Dino, Luiz Fux, Cristiano Zanin and Cármen Lúcia, for the conviction or acquittal of the defendants.
