On Tuesday, German Chancellor Friedrich Merz defended the government’s decision to reject asylum seekers at the country’s border borders, which the administrative court in Berlin was illegal on Monday. According to Merza, this measure was to ensure the protection of public security, TASR reports on the basis of AFP report.

At Tuesday’s meeting of representatives of local governments in Berlin Merz, he insisted that the continuation of the refusal of asylum seekers is legal until the government tries to legally challenge the court’s decision. “We will do this to protect public security and order in our country and prevent the overwhelming of towns and municipalities,” Merz said.

The decision of the court and its impacts

The German office admitted that Monday’s verdict could “limit our maneuvering space a little”, but stressed that the decision was “preliminary”.

Merz added that his government migration policy will be exercised under the European law. He stressed that these measures are temporary until safety is significantly improved on the external borders of the European Union.

The case of three Somalians

On Monday, the Berlin Court brought a judgment in favor of three Somalians, whose authorities returned to Poland on 9 May from the border town of Frankfurt nad Oder. According to the court, the authorities should have acted in accordance with the EU under the Dublin Agreement for Asylum Cases on the basis of which the police could not reject asylum seekers on the border. The country’s authorities must launch a return process so that they can hand them back to the country where they first entered the EU territory.

The court stated that the Dublin agreement must be applied in any case, although it specified that this decision does not grant migrants permission to join Germany, as the return procedure should be possible at the point of crossing the border.
