Minister André Ramos Tavares, of the Superior Electoral Court), ordered the businessman, owner of the Havan store chain and ally of former President Jair Bolsonaro (PL), for abuse of economic power in the 2020 elections. With the decision, Hang is ineligible by 2028 (eight years from the moment the facts analyzed occurred).
The sentence, on the 27th, also reaches the mayor of Santa Rosa (RS), Anderson Mantei (PP), and former mayor Alcides Vicini, also declared ineligible for the same period. It is up to appeal.
The case was taken to the Union People’s Coalition by Santa Rosa (PT/PCdoB/PDT/PL) and considered unfounded in the first and second instances of the Electoral Justice. Tavares analyzed a resource filed in the TSE by the coalition.
According to the case file, Hang was in the municipality of Rio Grande do Sul four days before the elections at the invitation of Vicini, then mayor, and, during participation in a campaign act, announced the installation in the city of a unit of his chain of stores.
“Luciano Hang played a central role in the conduct investigated, either as a public figure, or from the appeals of the legal entity of which he owns, so it is up to him to sanction ineligibility for the elections that take place in the 8 (eight) years of the 2020 election,” says the decision signed by Tavares.
The three denied irregularities. In his defense, according to the court ruling, Hang claimed that participation in the act “finds it hosted by freedom of expression, which removes the alleged electoral offense.”
Manori, the current mayor, supported the absence of sufficient evidence to conviction and Vicini, the former claimed the “unfeasibility of the discussion about the use of the public machine, especially for the attendance of servers to the site, as it is the appellate innovation, as well as the thesis that it was in the act of the function of mayor at the time of the facts.”
