PL triggers STF against increased IOF and calls for suspension of decrees

O PL sent this Wednesday (4) an action to Supreme Federal Court (STF) against the federal government’s decrees that increased the Tax on Financial Operations (IOF).

In the order, the PL calls for the full suspension of the decrees until the Supreme Court judges the case. The process still needs to be filed with the Court and distributed to a rapporteur minister.

According to the party, the decrees transform the IOF into a “collection mechanism” violates the Constitution, which requires the issuance of law to institute or increase taxes.

The PL also argues that there are no technical criteria that justify the increase in the rate.

At the end of May, the government announced the increase in IOF as a measure to expand the collection. Less than 12 hours later, in the face of the strong negative reaction of the market ,.

Now the government studies alternatives to ensure compliance with the fiscal target. According to Minister Fernando Haddad, the proposals will be presented to party leaders next Sunday (8).

The opposition maintains pressure against the increase and defends the total revocation of the presidential decrees. Haddad has not confirmed whether the increase in IOF will be completely revoked, but indicated that if the alternative plan advance there may be “calibration.”
