The first class of the Supreme Federal Court (STF) unanimously rejected the appeals presented by federal deputy Carla Zambelli (PL-SP) and hacker Walter Delgatti Neto, maintaining the condemnation of both for the invasion of the National Council of Justice (CNJ) systems, in 2023. Cármen Lúcia and Flávio Dino, confirms the penalties of ten years in prison in closed regime and loss of term to Zambelli, and eight years and three months to Delgatti.
Both were also sentenced to the payment of a solidarity compensation of R $ 2 million for collective damages, as well as individual fines. According to the complaint of the Attorney General’s Office (PGR), Zambelli commanded and planned the criminal action, with the objective of discrediting the judiciary. Walter Delgatti, who confessed to the crime, invaded CNJ systems and produced fake documents, such as an arrest warrant against Minister Alexandre de Moraes and a false blockade of goods worth R $ 22.9 million.
Federal Police investigations pointed out that counterfeit files found in the system coincided with documents seized with Zambelli. Delgatti said he received about $ 40,000 for the action, part of them through a former deputy advisor, although the PF identified alcohol expenses in these payments. Zambelli’s defense claimed curtailment of the right to broad defense and requested the reduction of the sentence or the annulment of the sentence, but the arguments were rejected. The rapporteur, Minister Alexandre de Moraes, said that the resources had merely delaying character and defended the immediate beginning of the execution of the sentence.
Zambelli left Brazil days after the conviction. According to the Federal Police, she crossed the border with Argentina by car and from there went to the United States. It is currently in Italy.
