The accusation that Moraes would be issuing illegal orders because they apply to US territory and violate freedom of expression in the country is at the heart of the Justice Department to the Minister last week.
But since the decision only applies to Brazil, the US government would be trying to interfere with an order of a Brazilian minister that only applies to Brazil, which would be a violation of the country’s sovereignty, in the view of the Brazilian government.
In February, the Rumble Video Platform and the President’s Social Network, filed a lawsuit against Moraes in a Federal Court in Florida, contesting a decision of the minister to permanently end Santos’s account and prevent the creation of new profiles.
The action requests that the Court declares as unenforceable in the orders of Moraes against the platform. It also asks the court to prevent the minister from determining other companies, such as Apple, to remove it at its platform application stores.
According to Rumble’s lawyers, the order would not be restricted to the profile of youtuber in Brazil, but it would be worth around the world, which, for companies, makes it illegal.

In the new petition, as a result, they ask the court to determine the payment of “compensatory damages” to companies, with the civil liability of the magistrate. In the document, lawyers call Moraes decisions “gag orders” and accuse him of censorship.
“Allowing Minister Moraes to silence a vocal user on an American digital platform would endanger our country’s fundamental commitment to open and robust debate. Neither extraterritorial dictates or abroad excesses can nullify the freedoms protected by the Constitution and US laws,” the action says.
In the letter of the Justice Department, whose full was revealed by the SheetAmerican authorities state that “according to consumed international law, a ‘state cannot exercise jurisdiction to execute in the territory of another state without the consent of this other state’.”
On May 28, the State Department announced that it would restrict the American visa to foreign authorities that practice censorship acts to US companies or residents.
In a post at X, the Secretary of State, Marco Rubio, specified that the Order had as objective Europe and Latin America.
On May 21, Rubio stated at the US House hearing that “there is a great possibility” for the US to impose sanctions against Moraes for alleged violations of freedom of expression.
