Minister Alexandre de Moraes of the Federal Supreme Court (STF) determined on Saturday (7) that the Ministry of Justice formalize the extradition request of Italy of the federal deputy licensed Carla Zambelli (PL-SP).
Contrary to the deputy’s statement that it would be “untouchable” For having Italian citizenship, experts and lawyers point to precedents of extradition between Brazil and Italy, even in cases of double citizenship, as explained by analyst Luísa Martins.

Extradition process
O Initially, the Ministry of Justice formalizes the request to Italy. Itamaraty then forwards the document to the Brazilian Embassy in Rome, which passes it on to the Italian Foreign Ministry.
Finally, the Italian office sends the request to its Ministry of Justice for admissibility judgment, which the agency verifies whether the request meets the legal requirements for extradition.
Then the request is forwarded to the country’s judiciary. Thus, it will be up to the Italian justice to make the decision on the extradition or not of Zambelli, if it is still in the country.
The order of extradition is related to Zambelli’s definitive condemnation, which admits no more resources. In addition to the arrest, other precautionary measures remain in force, such as the blockade of goods and values, aiming to make the deputy to permanence abroad.
. The minister argues that it is up to the house to formalize the loss of mandate, a point that historically generates friction between the legislature and the judiciary.
