Candidate Teresa Cristina Aguiar Tofanello Wiazowski (PP) was elected mayor of Mongaguá (SP) this Sunday (8.jun.2025). The supplementary election was held after the TSE (Superior Electoral Court) invalidates the candidacy of her husband, Paulinho Wiazowski (PP), winner of the 2024 municipal elections.
The 57 -year -old businesswoman won 17,948 votes (66.33% of the votes), against the mayor, Rodrigo Cardoso Biagioni (Union Brazil), who obtained 9,109 votes (33.67%).
The TSE determined a new election in Mongaguá after accepting a special appeal in December 2024. The decision declared Paulinho Wiazowski ineligible for irregularities in his accounts as mayor in 2012, failed by the City Council. Minister André Mendonça served as rapporteur of the case.
Judge Paulo Alexandre Rodrigues Coutinho considered that the flaws in the accounts configured willful act of administrative misconduct. The analysis pointed to the then manager’s inertia in reducing the public deficit, even after alerts from the Court of Auditors.
In the annulled elections, Paulinho Wiazowski had received 14,459 votes. The State Court of Auditors issued seven alerts during its term in 2012, indicating imbalance between revenues and expenses.
The Mongaguá City Council, in October 2023, considered the accounts of that year irregular through legislative decree. The document identified a variation of R $ 9,144,064.13 in the municipal budget.
Paulinho Wiazowski’s defense argued that, based on the new misconduct law (Law 14.230/2021), it would only be considered ineligible upon proof of specific intent or application of sanctions.
“The faults calculated by the ECA do not indicate dishonest conduct or intention to cause harm to the purse. The accounting failures pointed out in the judgment of the accounts, albeit reprehensible, do not constitute willful administrative misconduct and are not serious enough to justify the application“Said the defense.
