Condemned by the Federal Supreme Court (STF), federal deputy Carla Zambelli (PL-SP) escaped to be arrested last Thursday when he landed in Italy hours before her name appears in the red diffusion of Interpol, which makes her sought in 196 countries.

The dribble given by the Bolsanist to escape the order to add to other mishaps of the magistrate when trying to make his decisions involving Bolsonarists who left Brazil.

Like Carla, arrest orders against bloggers Allan dos Santos, who fled to the United States, and Oswaldo Eustáquio, currently in Spain, are still open. There are also dozens of investigated or even convicted of the January 8 coup acts that fled to other countries, including Leonardo Rodrigues de Jesus, who have not yet been arrested. From the list, however, only the federal deputy was included in the Interpol list, which facilitates her capture.

by the first class of the Supreme Court, for invasion of the computer device and ideological falsehood, for suspected invasion of the National Council of Justice (CNJ) system. On Friday, the Supreme Court rejected an appeal filed by the parliamentarian’s defense and confirmed the conviction. The deputy claims that hacker Walter Delgatti – also convicted, eight and three months – was solely responsible for the invasion and that he tried to assign her to blame.

In other cases, there is resistance from countries to comply with orders. Last month, for example, a court of. Brazil presented a new contestation, which has not yet been analyzed.

Eustáquio was arrested in 2020 for the suspicion that he worked to disrupt an investigation against him, under the inquiry of undemocratic acts, which has already been filed, but then gained the right to go to house arrest.

By 2022, there was a new arrest order for breach of precautionary measures, but he had already left the country at the time. After Brazil’s last appeal for extradition, the blogger’s defense claimed that there is a time limit for the presentation of the request and that the Brazilian judiciary commits abuse.

Allan dos Santos’s arrest was initially ordered in 2021, in response to a request from the Federal Police, on suspicion of criminal organization, crimes against honor and incitement to crimes, prejudice and money laundering.

The Ministry of Justice has requested the United States, still in the government of Jair Bolsonaro, the extradition of Santos, but to this day there has not been a decision of the American authorities, who have even asked for more information about the crimes committed by the Brazilian.

When his arrest was decreed, Santos’ defense claimed that there was no reason for pre -trial detention and that the decision was based on “mere conjectures.”

Prison in the US and Argentina

Meanwhile, at least 61 people already convicted by the STF due to January 8 left the country. Part of them was arrested in Argentina and the United States. There are also records of fugitives in Paraguay, Peru and Uruguay.

Last year, Moraes determined that the Attorney General of the Union (AGU) should “adopt the necessary measures for the realization of their extradition”. This process, however, is still in progress.

In January, four Brazilians convicted or investigated at the STF on January 8 were arrested in the United States for illegally entered the country. One of them, Cristiane da Silva, was deported in May and was arrested when she arrived in Brazil. Her defense claims she went to Brasilia for a walk.

In addition, at least five Brazilians were arrested in Argentina and face extradition process. An audience was scheduled for June 18.

A situation similar to Zambelli’s is Leo Índio, who left Brazil after becoming a defendant on the STF on January 8. He had an arrest order issued after announcing that he is in Argentina, but so far she has not been fulfilled.
