The deputies of the State Legislative Assembly of () approved on Wednesday (11), the bill that determines the regulation at the state level, through the municipalities, the use of motorcycles for the provision of paid passenger transport services, carried out through applications.

The text, which aims to create a legal framework that allows municipalities to oversee this type of activity, determines that the decision to authorize and regulate the use of motorcycles for the provision of services should be taken by the municipalities. According to Deputy Fábio Faria de Sá, the “growing use of motorcycles for paid passenger transport by application brings relevant risks to people’s safety, both for the driver and the service user”. For him, it is necessary to “regulate by municipalities who have or intend to include this local transportation. There was a need to complement current legislation. Technology constantly evolves and, with it, new needs are imposed and laws need to be updated. Our focus is on the safety of the passenger, the driver and all citizens”.

Dispute between city hall and applications is debate

The advancement of motorcycle motorcycle services by applications, such as Uber and 99, in São Paulo triggered a series of clashes between the capital of the capital and the companies. Since the early 2025, the municipal administration began to apply fines and seize motorcycles used in this type of service, claiming that passenger transport was not allowed by a current decree in the city. The official justification was the increase in traffic motorcycle deaths, which grew 20% by 2024.

Companies argue that the activity is supported by federal legislation, while recent court decisions have prevented the city preventing sanctions against drivers. The dispute accentuated the pressure for clear and uniform regulation on the service, culminating in the project approved by Alesp that returns to the municipalities the power to decide on the subject.
