Given the severity of the crimes committed by Edilson Florêncio da Conceição, 48, the Ceará Public Prosecution Service (MPCE) appealed to court asking for the increase of the application driver, initially sentenced to eight years in prison under a semi -open regime. The crime happened in Fortaleza (CE), at dawn on January 19 this year.
According to the appeal filed on Tuesday (10), the MPCE requests that the defendant to lose the right to appeal in freedom and that the penalty be served in a closed regime.
In addition to the conviction, the court had granted the driver the right to appeal in freedom due to his “good background.” In the appeal, prosecutor Neemias de Oliveira argues that there are grounds for the increase of the penalty imposed on the defendant.
“The agent’s guilt cannot be treated as ordinary. On the contrary, it proves to be sharply, as coldly and premeditated, led the victim to isolated, taking advantage of his vulnerability to consummate the libidinous act. The circumstances of crime further aggravate his reprobability: the deserted place, the nighttime, the risk of impending death and the complete disability and the complete disability. In a statement, defendant Edilson Florêncio’s defense commented explaining that although the crime is serious, the penalty must observe the principles of legality.
“The final penalty was fixed in 7 years, 9 months and 18 days, to be fulfilled under a semi -open regime, with the right to appeal in freedom. This decision does not acquit or represents impunity, but respects the law and due process, allowing the review of the case by higher instances,” said lawyer Carolina Dantas Azin Rocha.

Edilson was arrested after military police officers who were preventive patrolling in the Edson Queiroz neighborhood identifying a suspicious situation in a black car parked in a thicket. As they approached, the agents heard shouts and saw a woman trying to get rid of a man.
According to the victim, Renata Coan Cuduh, 19, she had requested a car by app to return to her residence. However, the driver led her to a forest area and immobilized her with a blow known as “lion forest”, making her faint.
The young woman reported that the suspect even threatened her with death and did not consume the threat only due to the arrival of the police.
