Obstetrician is sentenced to more than 6 years in prison for patient death in RS

One Obstetrician was sentenced to six years and 25 days in prisonin semi -open regime, due to the death of a woman after childbirth, in Parobé (RS). The condemnation concerns crimes of Major and ideological falsehood.

According to the Rio Grande do Sul Court of Justice (TJRS), the death occurred at the São Francisco de Assis Hospital, two months after Mariane Rosa da Silva Aita, 39, passing through a caesarean section. The doctor would have left a surgical gauze inside the patient’s abdominal cavity in June 2023.

In the sentence, the court stressed that the elements presented in the judicial process demonstrate the defendant’s negligent conduct and non -compliance with technical rules of the profession.

“The defendant acted negligently, missing with his objective duty of objective care, failing to inspect the patient’s abdominal cavity after the surgical procedure performed and before closing the abdominal wall,” said Judge Thomas Vinicius Schons.

The doctor was also held responsible for omitting, in the medical record, the removal of a compress left in the victim’s abdomen during the procedure, months after delivery.

“The accused entered false information in the victim’s medical records, in addition to hiding the mistake he made, remaining officiating in the medical area. Also, the defendant, altering the real truth of the facts, dismissed the material found directly in the contaminated trash, which he did to impossible expertise necessary to dismiss the events,” says the judge in the sentence.

The magistrate also set compensation for moral damages worth 100 minimum wages for each of the six children of the victim and for her husband, considering the psychological and economic impact caused by the loss.

Mariane left her husband and six children, one of them, the newborn baby. The decision is appealed.

Remember the case

In June 2023, Mariane Rosa da Silva Aita was admitted to the hospital for childbirth. During caesarean section, the doctor would have left a surgical gauze inside the patient’s abdominal cavity.

According to information from the RS Court of Justice, the complaint reports that, two months later, the woman returned to the hospital with severe abdominal pain and was again attended by the same professional. He then performed a new surgery to remove the foreign body.

However, the man would have omitted the information in the medical record, falsely recording that the procedure was intended for the removal of an ovarian cyst.

According to the Public Prosecution Service of Rio Grande do Sul, the patient remained hospitalized until August 23, 2023, when he died as a result of widespread infection and acute renal failure.
