The Federal Court determined that the Union, the Government of Amazonas and the City Hall to account for and identify the dead during the case in January 2021, during the Covid pandemic, and offer psychological attention to family members of the victims.
This Tuesday (10), Judge Marília Rocha de Paiva, from the 7th Federal Court, also ordered that the three entities provide accurate information, take human rights violations and develop internal courses of good practices in health emergencies.
The measures should be met within 90 days, except the beginning of the supply of psychological care to family members and the formation of the technical staff, which should start in the second half of this year, under penalty of $ 10,000 per day in case of non -compliance.
The decision occurs in the context of a public civil action filed by the Federal Public Prosecution Service and the Public Defender’s Office of Amazonas in April 2024. They claimed compensation of R $ 4 billion for the crisis, – R $ 1.6 billion for individual damage and R $ 2.4 billion for collective moral damages.
The main action is still awaiting trial. What the magistrate partially accepted on Tuesday, after more than a year, was an urgent tutelage, a legal instrument to anticipate the effects of a court decision when there is a risk of severe and imminent damage if the normal end of the process is expected.
She denied part of the MPF and Defensoria’s demands, as a public apology by governments and the disclosure of the court decision in newspapers and social networks, understanding that they would imply a prior recognition of guilt.
In the process, the three management maintains that there is no urgency and deny omission. The Union argues that health services are the responsibility of states and municipalities. The state argues that it has done everything that could face an exceptional world scenario, and the municipality, which is only responsible for primary care.
