A series of failures of the Judiciary, which began in Paraná in 2017, give clues to explain the approach of São Paulo to UOL columnist, confused with a 27 -year -old woman accused of murder.

The errors related to the case started more than seven years ago.

On October 16, 2017, at the Nova Esperança police station (481 km from Curitiba), housewife Mariana Rosa Soares, then 19, testified in a reception process. It was accused of selling a flat iron and a hairdryer stolen days earlier.

In the interrogation auto, it is reported that she did not present identity document, but there appear two numbers: that of her ID and the Sakamoto CPF.

The TJ (Court of Justice) of Paraná stated, in a statement, that the CPF “was informed by the defendant”.

However, attached to the same auto, there is a copy of consultation in the police investigation system of Paraná in which both Mariana and the journalist’s data were already figured. It has not yet been explained why the error was not remedied right there.

Lawyer Beatriz Gisele de Almeida Urganani, named Dativa (defender hired by the State in the absence of public defender), said she did not remember the case.

Throughout the process, the CPF registered for Mariana is Sakamoto. It was sentenced in September 2020 to one year in prison in an open regime and a fine of R $ 1,045 (R $ 1,423, in corrected amounts).

Less than a month after the sentence, the Nova Esperança Court detected the error and corrected it, according to a certificate provided to Sheet by the Court – in the case the correct CPF of the defendant. Even so, in later orders, the Sakamoto CPF again appeared, without explanation.

While the first action was following, Mariana was involved in a more serious crime, according to the Public Prosecutor of Paraná.

On the night of March 16, 2019, in a debt fight of $ 10 for a marijuana cigarette, she participated, with four adults and two teenagers, in the lynching of a man in the Jardim Novo Horizonte neighborhood. The victim died hours later in the hospital.

In this process, Mariana’s data were correct. She was condemned in a case that ran under the secret of justice, and, as she was on the run, her data ended up at the BNMP (National Bank of Criminal Measures and Prisons).

In the National Bank, however, the CPF inserted was again Sakamoto – information that fed the system consulted by PM Paulista and resulted in approaches last weekend.

The technique considered that Mariana was registered with the BNMP with the incorrect data at that time, perpetuating the misconception in the second process.

Lawyers who assist Sakamoto raise questions about the fact that the defendant randomly informed a CPF that, coincidentally, corresponds to that of the journalist, or even gave the document aware that it was him.

Sakamoto is known for the defense of human rights. At the time when the data exchange occurred, he made public criticism of Lava Jato, an operation based in Paraná. “This shows the fragility of systems, which can reach other people,” he told Sheet.

In addition to stating that it was Mariana who provided the wrong CPF and that the data had been corrected, the TJ-PR stated that “it is investigating the reasons why the BNMP has received the incorrect information and will take all the necessary measures.”

“BNMP is the responsibility of the CNJ. The system is fed by the courts; in the Sakamoto case, the filling was made by the Criminal Court of Nova Esperança,” the board said.

“The CNJ carried out the immediate correction of the data as soon as it became aware of the fact and reinforces the need for the court’s attention by filling information, under penalty of investigation by the National Court of Justice,” he added.

Mariana remains at large. The report unsuccessfully tried to locate family members to hear her.
