Minister Alexandre de Moraes of the Federal Supreme Court (STF) voted on Friday (13) for the conviction of Shirley de Andrade to 17 years in prison for participation in the scammer acts of 8 January. The trial takes place in the Virtual Plenary of the Court, where the other ministers have until June 24 to deposit their votes.
The accused was framed by crimes of armed criminal association, violent abolition of the Democratic Rule of Law, coup, qualified damage and deterioration of listed heritage.
According to the Attorney General’s Office (PGR), Shirley participated in the attacks “free, conscious and voluntary”. His performance was revealed from the apprehension of his cell phone, which contained geolocation audios, videos and data that prove his presence and actions during the invasion of the headquarters of the three powers.

In audio sent to a group of WhatsApp on January 8, the defendant celebrated the depredation: “We invaded the STF, invaded Congress, invaded the plateau (…). Everyone hurt, but we broke the whole STF, all, all, whole.”
“Only leaves if the army comes”
According to the complaint, Shirley went beyond passive participation. In other messages, she stated that the invaders would only leave the buildings after the decree of a GLO (guarantee of the law and the order), a common requirement among the scammers who expected military intervention.
She also recorded videos on the STF premises, mocking the destruction of the place:
“The house of Xandão finished. The scream which is? Lost, Mané! It only comes out if the army comes. Otherwise, we will be arrested.”
Moraes also pointed out that Shirley’s cell phone geolocation data show their presence in Brasilia in the months prior to acts, specifically in November and December 2022. According to the minister, this reinforces the planning thesis and previous organization.
In justifying the vote, Moraes stated that the elements of the process “overcome any doubt about the involvement of the defendant”:

“Forensic digital evidence, audiovisual records, real -time communications and geolocation data align, in order to overcome any questions about the involvement of the defendant.”
For the minister, the very messages sent by Shirley constitute an explicit and detailed confession of their leadership and execution of criminal acts.
