The Emergency Manufacturer – 06/13/2025 – Demétrio Magnoli

The US can no longer be classified as an institutionally stable country. In democracies, the stability of institutions is not affected by political crises, party polarization or popular manifestations. All this is part of the game. Instability emerges, however, when the executive lifts its spear against the separation and independence of powers. This is precisely Trump’s strategy.

The tactic consists of the rhetorical manufacture of emergencies that would provide the use of exceptional prerogatives. According to the White House, against all evidence, the US faces an economic emergency, a foreign invasion, real threats to the conduct of foreign policy and, finally, an internal rebellion. From this purely imaginary chaotic landscape, justifications are born for the invocation of legal statutes designed to face scenarios capable of endangering national security.

Trump launched his tariff war violating the international regimes of the World Trade Organization and, in this step, by executive decrees, tore the Trilateral Commercial Treaty with Canada and Mexico approved by Congress. Justification? The “emergency” expressed in structural commercial deficits of the largest economic power on the planet, whose GDP grew solid 2.8% in 2024.

Trump extended his deportations to immigrants with humanitarian visas under the insane pretext of “foreign invasion.” His government denied court hearings required by the law by deporting hundreds of Venezuelans on the unproven accusation of belonging to the Aragua Tren gang – and, before judges, invented the legend that the criminal group would be directed by a foreign government (in this case, the dictatorship of Maduro).

Trump ordered the arrest and potential deportation of student activists with regular visas and even the right of residence that, in the shadow of the first amendment, exercised freedom of expression. Exorbitant allegation: Their words would produce irreparable damage to the conduct of US foreign policy.

Trump crossed another border by convening forces of the National Guard and Marines to, in reverse of the California government, operate in the framework of the Los Angeles protests. Manipulating images, the White House displays depredations committed by a minority of protesters as evidence of a “rebellion” out of control against the immigration agency. Explicit threat: to appeal to the 1807 Insurrection Law to surround the prohibition on the use of military forces in internal repression.

In a historic sentence, in 1952, the US Supreme Court vetoed Truman’s decree, justified by the Korea War, of nationalization of strikes paralyzed by strikes. The decision was advised by the famous argument of Judge Robert H. Jackson, who explained the caution of the nation’s founders to check out emergency powers to the presidents: “They knew what emergencies were, knew the pressures that engender for imposing actions and also knew how they provide easy pretexts for usurpation. to sow emergencies. “

Trump does not face any emergency: manufactures emergencies to concentrate powers and, at the end of the line, destroy American democracy.
