BETS REGULATION: How to promote responsible care with consumers

With accelerated growth and complaints involving influencers, study defends a model of clear rules regulation to ensure safety and freedom in the online betting market

Recent requests for indicating influencers, and 14 for illegal advertising of online bets reinforce the urgency of a clear and responsible model for this market. In 2024, Brazilians bet R $ 240 billion on digital platforms, and the accelerated growth of the requires a transparent and effective performance of the authorities. In a study sent to parliamentarians, the liberal association has suggestions that balance mechanisms of self -execution and inclusion of alerts so that gamblers make better informed decisions, as well as favoring public collection and integrity in sports.

The proposal starts from the realization that the current model – based only on the granting of operators’ authorizations and self -declarations – is insufficient to ensure security to users and effective tax collection. “Today, the platforms operate with little transparency, some using ghost companies or without ties to the sector. This makes it difficult to report fraud and supervision by the government,” explains Magno Karl, Free Executive Director.

The technical note recommends a hybrid model, inspired by international experiences, which combines public authorization, independent technical certification and continuous monitoring of operators. Among the main points defended are:

  • Consumer protection: Individual CPF extract with gains and losses, and voluntary self -execution tool for players with compulsion history.
  • Transparency and Power of Choice: Public ranking with the rate of return of each operator and clear disclosure of the rules and probabilities of bets.
  • Technical security: Independent certification of platforms to ensure systems integrity, data protection and fraud prevention.
  • Combat to informality: PIE KEY REQUIREMENT Identified to curb ghost companies and ensure feature traceability.
  • Responsible advertising: Clear rules for campaigns and sponsorships, especially in high -range channels between young people and vulnerable people.

According to the study, the hybrid model avoids both regulatory capture – when operators excessively influence the regulator – and the creation of excessive barriers to the entry of new companies in the market, stimulating a competitive and responsible environment.

“More than collection, the financial and emotional health of millions of Brazilians is at stake. Livres’s proposal does not bet on the ban, but a clear and effective performance, based on good practices and defense of public interest – with freedom, yes, but with responsibility,” concludes Karl. .
