The (Federal Supreme Court) has ruled that those provided for next Tuesday (24) will be restricted to the parties, without transmission of or access to the press.
The hearings will be chaired by the minister in two sessions: the first with the defendants and, and the second with the defendant and the witness.
The defense of Braga Netto asked on Tuesday (17) the postponement of the caress. Lawyer José Luis Oliveira Lima says he is abroad and suggested that the hearing will take place on the 27th.
Former army chief Freire Gomes asked the Supreme Court to participate in the video conferencing session-as it occurred in his statement at the beginning of the process. His lawyer claimed that the military is in Fortaleza (CE) with the family.
“Personal attendance at the headquarters of this Supreme Court configures an excessively costly act for the witness. Videoconference technology, which is now widely used in the judiciary, offers the ideal solution for the case, harmonizing the interest of justice with the new factual situation of the petitioner,” he says.
Moraes has not yet responded to the demands presented by the parties.
Acareration is used in lawsuits to confront people who have made divergent statements about the same facts. The two deponent should be in the same room to discuss the differences in versions.
In this case, the main controversy is about the testimony of Mauro Cid. He told the Supreme Court that he received cash in a wine bag of former Minister Braga Netto to deliver her to the military who, according to the accusation, planned the murder of Alexandre de Moraes.
Braga Netto denies that he handed over money to Mauro Cid, and Lieutenant Colonel says he does not remember details of the fact, such as the date, time and place where he would have received the resources.
Already Anderson Torres wants to confront the version of General Freire Gomes. The military told the Federal Police that, from what he remembered, the former Justice Minister had attended a coup plot meeting.
