The court of Rio Grande do Norte sentenced to 2 years and 4 months in prison Flavio Dantas de Souza, for threat, slander and injury crimes against the Supreme Court Minister Alexandre de Moraes.
In August 2022, Flavio recorded a video in which he was a member of the al-Qaeda terrorist organization and threatened to explode a bomb, citing the name of Moraes explicitly. The content circulated in WhatsApp groups.
“Naughty, we will explode where you are and we will perform you and your todinha race,” said Flavio in the video, performing as a “terrorist”.

PF seized cell phone from the accused after the video viralizes
With the repercussion of the threats, the Federal Police fulfilled search and seizure warrants. In the operation, agents confiscated electronic equipment, including the defendant’s cell phone, which contained the original video.
The Federal Public Prosecution Service (MPF) denounced Flavio for offenses committed against civil servant in the exercise of the function, which aggravates the penalty provided for in the Penal Code.
Judge rejects play thesis and highlights threat tone
Flavio’s defense claimed that the video was a “joke” restricted to a private environment, with no real intention to cause damage. The judge, however, refuted the arguments.

“The threats of death and execution are straightforward and serious,” wrote the Prata Judge. “The imputation of crimes such as being ‘Bandit of the CCP’ and receiving bribes is objectively slanderous. The curses given are clearly insulting.”
For the magistrate, the tone of the video makes clear the threatening, slanderous and injurious character of speech. In addition to the prison sentence, the convict must pay compensation of 48 fine days.
