OAB -SP Creates commission to suggest changes in the judiciary – 18/06/2025 – Panel

Its study committee for the reform of the judiciary, in order to present a list of projects on the subject to the presidents of Congress, Davi Alcolumbre (Union-AP) and the STF, currently Luís Roberto Barroso.

“In the last two decades, the judiciary has strengthened, expanded, has gained relevance, budget and structure. All this needs to be accompanied by efficiency, transparency and participation,” says OAB-SP President Leonardo Sica.

The goal is to present the proposals in the first half of 2026, when Barroso will have given way to Edson Fachin in the STF.

The commission will consist of former STF presidents Ellen Gracie and Cezar Peluso, former Justice Ministers José Eduardo Cardozo and Miguel Reale Jr., professors Maria Tereza Sadek, and Alessandra Benedito and former OAB-SP Presidents Patricia Vanzolini and Cezar Brito National OAB.

Commission topics are broad, according to Sica, but should include, among others, rules of virtual judgment, mandates for STF ministers, monocratic decisions and clearer rules for a magistrate to declare himself prevented or suspicious. The issue of salary “hangers” in legal careers can also be addressed.

“Judges have a monopoly of applying the right, but not to manage justice. This has to be a task shared with lawyers, prosecutors, academics and society in general,” says the president of OAB-SP.

A particular concern is with the defense of the lawyers’ prerogatives, at a time when virtual judgments proliferate.

The OAB has resisted a guideline from the CNJ (National Council of Justice) for lawyers to send their oral support by audio to the judges before the trial.

“There need to be clearer limits and rules,” says Sica.

According to him, the main objective of the creation of the commission is to rescue the population’s confidence in court. “We are very concerned with justice to be guided by office rules, by regiments, provisions, resolutions. This is undemocratic, it has to be in law, to be discussed,” he says. “The loss of trust in justice is bad for democracy,” he adds.
