After completing the third and last instruction hearing on the case of the 27 -year -old merchant Igor Peretto, stabbed to death by his own brother -in -law, in August last year on the coast of São Paulo, Justice of São Paulo must define the future of the defendants in the coming weeks.
According to the Court of Justice (TJSP), at the hearing, which took place last Monday (16), witnesses were heard and the defendants were questioned.

In a statement, the TJSP stated that it granted a two -day deadline for the defenses to manifest. After this phase, the parties must submit to the court the final allegations in writing. Subsequently, with the completion of these steps, it will be decided if the defendants (Mario Vitorino, Marcelly Peretto and Rafaela Costa) should or not go to the popular jury.
The court also stressed that if the trio is taken to the jury, the defendants may appeal the judgment.
What the defendants’ defenses say
Marcelly Peretto’s defense – Igor’s sister – said the process is still in the “complementary phase of diligence.” According to the lawyer, the forecast is that the decision will leave about two weeks.
Already the lawyer of Mario Vitorino – brother -in -law of the victim – said he verified the existence of some pending steps, including access to the case file about the “data leakage” that happened during the investigations of the case.
“Mario Vitorino’s defense points out that after the judicial oral evidence, absolutely all the points described in the complaint remained completely fragile. This is because the police itself, through the police delegate and the investigators heard in the three hearings were all emphatic in the sense that there was no Talsal (expression never cited and even minimally agreed in the case), there is no kind of economic motivation and premeditation, the lawyer said,” in note.
The defense of Rafaela Costa – Igor’s wife – also spoke and stated that she presented to court the necessary answers within the established deadline. “We await the release of our client, behold, the imputations contained in the complaint were absolutely dismissed by the probationary set produced, not authorizing submitting Rafaela to the popular jury. Facts that will be detailed in the final defensive allegations,” concluded the lawyer.
The lawyer who represents Igor Peretto’s family stated that the court, next week, should analyze the defenses’ demonstrations and make room for the continuity of the process.
Loving triangle
He was stabbed and killed in August last year in an apartment in Praia Grande, on the coast of São Paulo. In addition to Rafaela, Marcelly Peretto and Mario Vitorino da Silva, Igor’s sister and brother -in -law, respectively, are also suspected of the crime.
According to investigations, the suspects were together at Marcelly’s apartment before Igor was found on the spot. According to the civil inquiry of the case and the prosecution’s complaint, the crime was planned, since Mario, Rafaela and Marcelly considered Igor a hindrance to the “love triangle”, that is, for the relationship that the three reported had among them.
Rafaela, considered the “pivot” of the crime, would have been related to Igor’s sister before the crime. Asked, Marcelly’s defense stated that the woman reports that she was drunk and was kissed the strength and caressed by Rafaela.
After the crime, the suspects fled and tried to hide evidence, but were later arrested.
