The Minister of (Supreme Federal Court) determined on Thursday (19) that the man who broke a historical clock during the scammer acts of January 8, 2023 to be arrested again.
Moraes stated that a decision that released the mechanic Antonio Claudio Alves Ferreira contradicts the law. The minister argued that a first instance judge would not have jurisdiction to deliberate on the prison regime of the defendants of 8/1, whose proceedings are conducted by the STF.
Ferreira was released by decision of Judge Lourenço Miglioni Fonseca Ribeiro, from the Uberlândia Penal Execution Court (MG). Sentenced by the STF to 17 years in prison, the man was released after two years and four months of detention.
According to the court decision granted the defendant progression to the semi -open regime, he fulfilled the necessary fraction to receive the benefit, did not commit any serious misconduct and has “good prison conduct”.
According to Moraes, the judge “made a decision outside the scope of his jurisdiction, and there is no decision of this Supreme Court that has attributed the jurisdiction to any measure except the mere issuance of the penalty certificate”.
“Although it was not so,” he said, in deciding to grant the semi -open regime, the judge “made him in contrast to the law.”
Moraes had the magistrate’s conduct investigated. According to the minister, he acted in disrespect for the jurisdiction of the Supreme Court and violating the law of criminal executions, which provides that prisoners convicted of crimes of violence and serious threat can only pass to the semi -open after serving 25% of the sentence – the mechanic would only have 16%, according to Moraes.
“The judge’s conduct must therefore be properly determined by the police authority under this Federal Supreme Court,” he said.
The defendant was released without an electronic anklet because there are no equipment available in Minas Gerais, according to the judge, who wrote that there was no forecast to regularize the situation and that the prisoner could not be harmed by the delay of the state.
The State Secretariat of Justice and Public Security of Minas, linked to the Romeu Zema government (Novo), however, said that there is no lack of lack of equipment and said that there are more than 4,000 active vacancies in the monitoring system.
The portfolio said that in cases where the person has residence in a district different from the prison, such as Ferreira, there is a possibility of release without monitoring, only with house arrest.
“In this way, there is a legal deadline of 60 days for him to provide the address at the Uberlândia District and attend the Regional Electronic Monitoring Center to put the anklet. We inform that Antonio Claudio Alves Ferreira is already scheduled for the coming days,” he said in a statement.
Security cameras recorded Ferreira on the 8/1 depreding the clock that arrived in Brazil for over 200 years. The item was a gift from the French government to Dom João 6th and had been in the country since 1808.
The clock was restored and returned to the Planalto Palace in January this year. The play is in the audience room, near the office of the Presidency of the Republic.
