The minister Alexandre de Moraesdo Supreme Federal Court (STF)ordered that the court’s police authority investigates the conduct of the judge LOURENÇO MIGLIORINI FONSECA RIBEIROdo Court of Justice of Minas Gerais (TJ-MG)which had determined the release of Antônio Cláudio Alves Ferreiracondemned to 17 years in prison for the acts of January 8.
“Judge Lourenço Miglioorini Fonseca Ribeiro, from the Uberlândia/MG District Court of Criminal Executions,, and there is no decision of this Supreme Court that has attributed the jurisdiction to any measure except the mere issuance of the penalty certificate,” said Moraes.
This Thursday (19), in determining again the arrest of Antonio Ferreira-which broke Balthazar Martinot’s historical clock, in the Planalto Palace-the minister said that the TJ-MG acted outside his competence, and released the defendant first and before the law.
“The defendant is primary and was convicted of crimes committed with violence and serious threat, so that his transfer to the semi -open regime could only be determined – and exclusively by this supreme court – when the prisoner had served at least 25% of the sentence,” the minister continued in the arrest warrant.
On Monday (16), o. The judge understood that the convict already fits the progression of closed regime for the semi -open.
In the decision, the magistrate explained that the release of Antonio would be without an electronic anklet due to the lack of equipment in the state. Antonio was stuck for almost a year and a half.
“Considering that the reeducating cannot be harmed due to the slowness of the state, I determine the immediate compliance with the unknown release permit, and the prison unit must include the reeducating in the waiting list to include electronic equipment,” the judge said in the decision.
