It arrested it on Friday (20), in Catalan, Goiás, the man convicted of breaking a historic clock during the scammer acts of January 8, 2023. The arrest was determined by the minister, (Federal Supreme Court).
The mechanic had been released on Wednesday (18) by decision of Judge Lourenço Miglioorini Fonseca Ribeiro, from the Uberlândia Criminal Court (MG), which determined the progression to the semi-open regime, understanding that he was already entitled to change.
According to the Federal Police, the arrest was carried out by federal police officers in cooperation with military police from Goiás and with the support of the Integrated Force to Combat Minas Gerais organized crime.
During the demarches, the Federal Police said the police also located and arrested a second -person, fugitive from justice, who had an open arrest warrant and maintained a kinship with the mechanic.
In determining the arrest, Moraes stated that the judge had no jurisdiction to make this decision and that the convict did not comply with the time in prison so that he could migrate from the regime. Ferreira was convicted by the STF to 17 years in prison and was released after two years and four months of detention.
In the judicial decision that established the release, the judge said that Ferreira fulfilled the necessary fraction to receive the benefit, did not commit any serious misconduct and has “good prison conduct”.
Moraes countered, in the order issued on Thursday night, saying that the judge “made a decision outside the scope of his competence” and that he had no authorization from the STF for such conduct.
In addition, he stated that the mechanic did not serve a timely time because he was convicted of crimes of violence and serious threat, which requires a higher percentage in the closed regime.
Ferreira served 16% of the sentence in closed regime, but, according to Moraes, the correct thing would be that he passed to the semi -open only after 25% of the total conviction time, given the severity of the crimes.
“The judge’s conduct must therefore be properly determined by the police authority under this Federal Supreme Court,” the minister determined.
The General Corregedoria of the Court of Justice opened a procedure on Friday (20) to investigate the judge’s decision.
“TJMG reaffirms its commitment to legality, the principles of the Democratic Rule of Law and the unrestricted respect for court orders issued by the Superior Courts,” says the Minas Gerais Court of Justice on the opening of internal investigation.
