Moraes countered, in the order issued on Thursday night, saying that the judge “made a decision outside the scope of his competence” and that he had no authorization from the STF for such conduct.

In addition, he stated that the mechanic did not serve a timely time because he was convicted of crimes of violence and serious threat, which requires a higher percentage in the closed regime.

Ferreira served 16% of the sentence in closed regime, but, according to Moraes, the correct thing would be that he passed to the semi -open only after 25% of the total conviction time, given the severity of the crimes.

“The judge’s conduct must therefore be properly determined by the police authority under this Federal Supreme Court,” the minister determined.

The General Corregedoria of the Court of Justice opened a procedure on Friday (20) to investigate the judge’s decision.
