STF includes military school students in the quota system

With the decision, a group of students may apply for vacancies reserved at universities and federal high schools

The (Federal Supreme Court) concluded that students from military colleges can dispute places reserved for public school students at federal universities and federal high school technical education institutions. The decision unanimously was made at the judgment of ADI (direct action of unconstitutionality) at the virtual session completed on June 13.

The (Attorney General’s Office), the author of the action, argued, among other points, that military colleges would not be classified as public schools and, therefore, students of these institutions would not be contemplated by.

In his vote, the rapporteur, Minister Gilmar Mendes, noted that, despite being subject to the Army Education System, military colleges have a public nature already recognized by the Supreme Court.

He recalled that the quota vacancies are disputed only by candidates who do not qualify in the wide competition, and the reserve is divided into two parts:

  • 25% of the general vacancies are intended for students from public schools from families with income equal to or less than one minimum wage;
  • Another 25% are reserved for students from public schools generally.

The quota law states that at least 50% of vacancies in federal higher education and high school institutions are intended for students who have attended all high school in public schools.
