On Tuesday (24/6), the government must present a calendar proposal to pay to retirees and pensioners who suffered improper discounts on the benefits paid by. The hearing will be held at the Federal Supreme Court (STF). Among the topics under discussion will be the form of correction of the values to be returned and the strategies to ensure the resources necessary for reimbursement.
The conciliation meeting was determined by Minister Dias Toffoli, rapporteur of the actions dealing with the subject in the Court, after a request from the Attorney General of the Union (AGU).

“It is essential to reflect on the adoption of alternative conflict solution instruments, aiming at both the repair of the already consummated injuries and the prevention of new infractions harmful to the affected insured”, AGU said in the request.
In authorizing the opening of negotiations, Minister Dias Toffoli highlighted the importance of avoiding “the spraying of diverse legal solutions to identical facts, thus obtaining speed, homogeneity and effectiveness in the protection of vulnerable rights and guarantees”.

According to federal government announcement last week, the amounts must be paid in a single installment by the end of this year. During the hearing, a proposal will be submitted to an agreement, which will include the schedule of payments. The expectation, according to the AGU, is that the refund occurs simplified.
Payments are expected to be made in lots, with 15 -day intervals between each. There will be no distinction of groups, and the values will be returned with monetary correction. In addition to the refund, the government works so that, in judicial instances, it is guaranteed that the associations involved pay to the public power the amounts due.
Correction of values by inflation
During the hearing, the government should also discuss what will be the index used to correct the values for inflation. According to INSS President Gilberto Waller Júnior, the proposal is to adopt the IPCA, the official rate of inflation in the country, as reported to TV Globo.
Although social security benefits are readjusted annually based on INPC, which reflects inflation for lower income families, government calculations indicate that the IPCA has been high in the last five years. Therefore, the use of this index would be more advantageous for retirees and pensioners affected by fraud.
