Judge Lourenço Miglioni Fonseca Ribeiro, from the Uberlândia Criminal Execution Court (MG), told the Federal Police on Monday (23) that he committed a “mistake” by sending, sentenced by the Supreme Court (STF) to 17 years in prison for participation in the scammers of January 8.
According to the magistrate, the electronic system of justice incorrectly classified the process to be of its jurisdiction. “The registration error led him to believe that he would be acting in a process of his competence, otherwise he would never have decided,” says the testimony obtained by the PF.
After the release, Minister Alexandre de Moraes, rapporteur of the case in the Supreme Court, and ordered the opening of an investigation against the judge. For Moraes, Ribeiro “has no legal competence” to address issues related to processes from the Supreme Court.

In the order, Moraes reiterated that only the Supreme Court can decide on the proceedings of the convicts for attempted coup. The minister also pointed out that the mechanic, responsible for destroying Balthazar Martinot’s historical clock in the Planalto Palace, is not entitled to regime progression.

In the testimony to the PF, Ribeiro stated that he had no intention of confronting or usurping the jurisdiction of anyone, a court of justice or a higher court. ”
He also said respecting all institutions and that the decision was made based on the information available at the moment.
