“The project is correct, each municipality has its peculiarities and better conditions to define on public mobility policies also aiming at security and protection of life,” Nunes told the panel after the project approval at Alesp.
Companies that offer applications transport, on the other hand, maintain that the measure is unconstitutional. According to them, the Supreme Court did not restrict the service, but allowed municipalities and states its regulation.
The project provides that the transport of passengers by motorcycles is subject to specific taxes and the registration of the rider as a taxpayer of the INSS (National Institute of Social Security).
And the professional registered to provide the service must comply with requirements such as having the National Category A qualification portfolio, with authorization for paid activity; negative certificate of criminal record; and even safe for passengers.
