Judge Juan Carlos Peinado to the Minister of the Presidency, Justice and Relations with the Cortes, Félix Bolaños. The magistrate appreciates that Bolaños was able to commit the crimes of false testimony, considering that he lied in his statement last April about who had the competition for the hiring of an advisor to Begoña Gómez, the wife of the president of the Government; and embezzlement, for his alleged participation in the hiring of that same advisor. In the car of that reasoned exhibition that Hajinado has sent to the Supreme Court by mistake to the president of the president.

In the document, the judge recounts in his office on April 16 of this year. On that occasion, the minister replied that Cristina Álvarez did not know her at all before she got to work with Begoña Gómez. And he knew he worked as his assistant because he was notorious and always accompanied her. That he had also coincided with that advisor two or three times, one of them in the presentation of the government president’s candidacy for the 2019 generals.

The error occurs when the judge refers to the last time that Bolaños and the advisor would have agreed. And he says textually: “The last one was in the funeral home for the death of Mrs. Begoña Gómez.” A reference clearly wrong, which could actually refer to the death of Begoña Gómez’s father, Sabiniano Gómez, which occurred in June 2024, months before the Minister’s statement against Judge Peinado.

Excerpt from the reasoned exhibition of Judge Juan Carlos Peinado in which he erroneously refers to the death of Begoña Gómez, wife of the President of the Government.

It is not the only imprecision of that document that the judge has sent to the Supreme. He is also wrong when he refers to Alfredo González Gómez, then Deputy Secretary General of the Presidency. He says that he proceeds to file the cause against him, “by understanding that there is no indications of acting criminal in this investigated,” but in reality he was never charged. In fact, just in the following paragraph he acknowledges that he was summoned as a witness.

Throughout all the reasoned exhibition, 32 pages, hairstyle refers to the minister as “the now investigated”, when Félix Bolaños actually is not being investigated. In fact, that is precisely what the judge asks to the high court in this decision. When the minister declared before the magistrate in April of this year he did it as a witness, because at the time of hiring under suspicion he was the general secretary of the Presidency.
