Julieta Makintach is no longer a judge. This 47 -year -old Argentine magistrate, a member of the Court who tried whether or not there were criminal responsibilities in the death of Diego Armando Maradona, presented his resignation on Tuesday. The Prosecutor’s Office revealed that Makintach had authorized the recording of images during the trial for Maradona’s death without the consent of the other two members of the court or the parties for a documentary series entitled Divine justice. The judge was going to be the star of that audiovisual project, as can be seen from the trailer and the script found in the offices of the producer. and a cataract of complaints against the judge.

Makintach presented his renunciation letter on the same day as the prosecution jury began to analyze his case. In the text addressed to the Buenos Aires governor, Axel Kicillof, says that he voluntarily departs from the position in the context of “the facts of public knowledge that have generated a deep institutional and social impact.” He maintains that his decision seeks to reduce the damage caused to public confidence in the Judiciary.

Detention request

Once Kicillof accepts the resignation, he will lose the fueros and justice will have a free way to investigate it. Fernando Burlando, a lawyer who represents Maradona’s older daughters, anticipated that he will request that Makintach go prey. “This resignation removed what could protect it for a detention. We are going to ask that the prosecutor also supports that request that we are going to do to the guarantee judge,” mocking in dialogue with Radio Rivadavia.

At the beginning of the month, the Attorney General Buenos Aires, Julio Conte Grand, denounced Makintach before the Permanent Secretariat of Procedure of Judges and Judicial Officials. Conte Grand said there is evidence that “proves without fissures” that the judge’s conduct responded to exclusively personal interest. “It is unfortunate that the magistracy has used and, in short, the power granted by the State, to achieve it,” referring to that merely personal interest.

Among the irregular behaviors of the then judge of the Federal Oral Court 2 of San Isidro indicated by the Attorney General is to have violated the prohibition of filming the debate that had imposed the same court that she integrated and had lied deliberately by denying her participation in the documentary. Both the complainant lawyers and those who defended the seven charged with Maradona’s simple homicide agreed that Makintach had incurred in manifest partiality and requested the nullity of the process, which was granted.

The new trial still has no start date, but the new court that will carry it out has already been drawn. It will be the number 7 of the town of San Isidro, composed of Roberto Gaig, Alejandro Gago and Alberto Ortolani. They must request new proof measures, listen to the witnesses and the accused and determine whether the death of Maradona, which occurred on November 25, 2020, could have been avoided.

According to prosecutors who investigated the case, the former soccer player was due to the poor performance of the health professionals who were in charge of Maradona’s rehabilitation after having undergone cranial surgery. Four doctors, two nurses and a psychologist are accused of the simple homicide of the football star and face sentences between 8 and 25 years in prison.
