Company wanted to recognize the judicial deposit as payment of the grant, but judge says authorization is from the executive
The Federal Court ordered on May 29 that the betting company online game zone could no longer act as regular BET. The federal judge Itagiba Catta revoked the injunction (provisional but immediate effect) that granted the authorization.
The magistrate said that the competence to judge whether a brand is lawful or is not up to the executive branch. The responsible body is that of the Ministry of Finance.
“In the present case, it is not up to the judiciary to replace the Secretariat of Awards and bets to determine the issuance of authorization, as this would imply improper interference in the administrative process”says the text. Read the decision (PDF – 50 KB).
The Game Zone Business and Participations filed a writ of mandamus against the Secretariat in December 2024. Asked the following:
- use of judicial deposit of R $ 30 million recognized as payment of the grant;
- Publication of a Ordinance authorizing the exploitation of betting activity for 5 years;
- Issuance of the company’s “Bet.br” domains.
The injunction with this authorization was issued in January 2025. Thus, the company entered the list of websites released to function because of judicial determination.
The Union appealed (interlocutory appeal) against the injunction, but the Federal Regional Court of the 1st Region denied the appeal. The game zone claimed that the injunction was not being met.
The last movement in the 4th Federal Civil Court of the Judicial Section of the Federal District was on May 29.
