One of the main whistleblowers of, the moneymaker asked on Tuesday (24) to the minister of the (Supreme Court), the recognition of the suspicion at the head of the 13th Federal Court of Curitiba and, consequently, the annulment of the condemnatory sentences signed by him.
Today senator for Paraná and affiliated with União Brasil, Moro was the head judge of the Lava Jato Court until the end of 2018, when he left office to become Minister of (PL).
In the STF’s request, Youssef’s defense argues, among other points, that the moneymaker “was an instrumentalized collaborator” by the former judge and the Federal members to “hit names getting closer to the workers’ party summit, as a political target to be persecuted by these public agents, for the benefit of their private power projects.”
The defense also remembers the Supreme Court that Moro had already been suspected in 2010, due to an intimate forum, as part of an investigation investigating Youssef in the Banestado case.
“However, with the outbreak of Operation Lava Jato in 2014, which proved to be a promising platform to leverage his personal promotion project, the magistrate realized that he could not be away from the case. So, as in a magic, deliberately no suspect,” writes the moneymaker’s lawyers.
In another excerpt from the Supreme Court, Youssef’s defense also cites the illegal staple episode in the money changer in 2014 and the hacked and seized messages in Operation Spoofing. For the defense, there was a collusion between Moro and MPF prosecutors.
“After being the victim of illegal interception of the PF, he was deceived by a pseudoinvestigation, ordered by former Judge Sergio Moro and led by the same organs involved in the installation of listening –PF and MPF-evidencing collusion between the authorities,” says the petition.
Prior to benefiting from a collaboration agreement, Youssef was trapped in a PF Superintendence jail in Curitiba and an irregularly installed listening recorded 260 hours (11 days) of conversations.
He spent two and a half years in jail in Paraná.
Procedures were opened by the PF at the time to investigate the situation, but Youssef’s defense maintains that the episode.
“Contrary to what is stated by and endorsed by former judge Sergio Moro, the listening device was in full operation and audios were illegally captured, facts that were intentionally omitted from the defendants, their respective defenses and the national press,” says the petition to the STF.
Moro has always denied having committed irregularities as Lava Jato judge and, in the past, has already stated that “any insinuation” of his involvement in the case of clips “is slander.”
Until the night of Wednesday (25), Toffoli had not yet tried the Youssef’s request. If the convictions are annulled, the decision should not interfere with the donor’s collaboration agreement.
