The general’s lawyer asked the OAB-SP intervention in the criminal action ‘to ensure that the professional prerogatives of postulant lawyers are restored and guaranteed’
The defense of the general asked the Brazilian Bar Association of São Paulo (-SP) to intervene in the trial of the coup plot that is being processed in the Federal Supreme Court (). Lawyer José Luis Oliveira Lima accuses the minister to violate prerogatives by preventing the recording of the interim between Braga Netto e. He further justifies that “the absence of any visual and sound record of caressing is absolutely incompatible with the magnitude of this judgment.”
For the defense of the general, “the recording made by lawyers, therefore, is expressly provided for by the law and is independent of judicial authorization”, according to the document filed with OAB-SP.
Alexandre de Moraes, rapporteur of the criminal action, denied the request to record the confrontation between Cid and Braga Netto since “the interim is an act of instruction of the court and not an act of defense”, according to the minutes of the hearing. In addition, the minister understands that the recording would cause “improper pressures, including by past leaks of what would or would not be asked to the ordeal, who could compromise criminal procedural instruction.” Moraes also pointed out that the minutes of the session will be released as soon as it is joined to the file.
Braga Netto’s lawyer asked the OAB-SP intervention in the criminal action “to ensure that the professional prerogatives of postulant lawyers are restored and guaranteed”, as well as asking the entity to question Moraes about the prohibition of recording.
