The National Court investigates as cyber -terrorism the dissemination of personal data of Sánchez and other high positions | Spain

The National Court has opened an investigation for cyber -terrorism or for crime against high institutions of the State for the recent dissemination through at least two ultra ideology Internet chats of the personal data of thousands of people, several of its ministers, regional presidents and other high public positions, as well as militants of leftist parties, as they have confirmed to El País Judicial Sources. The spokesman, Pilar Alegría, indicated this Friday that the leaks “have to worry” and ask justice to “investigate and point out” to those who have published the data.

The decision has been made by the head of the Central Court of Instruction number 1, Francisco de Jorge, after receiving last week a report from the General Information Police Station (CGI) of the National Police in which he informed him that in a chat of the application of Telegram messaging with more than 90,000 users, two of them under the pseudonym @KKASPAC Telephones, ID numbers and email addresses (some old or erroneous, but others updated) of seven ministers – among them the First Vice President and Minister of Finance, – and several former leaders of the PP and Podemos.

A day later a second filtration occurred. On that occasion, personal data from other government members were disseminated – such as the Minister of Presidency and Justice, Félix Bolaños, and the Second Vice President and Labor Minister, Yolanda Díaz; of the president of Congress, Francina Armengol; of the president of the Generalitat, Salvador Illa, and of the leader of Podemos Ione Belarra, as well as the four main investigated by the alleged: the former owner of the portfolio, José Luis Ábalos: his exassor, Koldo García; the former Secretary of Socialist Organization Santos Cerdán, and the businessman and commissioner Víctor de Aldama. Data from 300 PSOE affiliates also appeared.

This Thursday the third data filtration was recorded, now for a second chat in Telegram with fewer followers – something more than 1,000 – having allegedly blocked the first. This included information from Sánchez (his ID number, personal email address, date of birth and address in Madrid), of nine other ministers, as well as autonomous leaders such as Extremadura María Guardiola and Andalusian Juan Manuel Moreno, the former mayor of Barcelona Ada Colau, as well as 3,000 members of Podemos. In the new chat the data of the previous two leaks were hung again.

The National Court has assumed investigation by considering that this massive filtration of personal data on the Internet can be framed, after the 2015 reform of the Criminal Code, as a crime of terrorism. The law contemplates that this type of can be classified as terrorism if, among its alleged purposes, it is “subverting the constitutional order, or deleting or severely destabilizing the functioning of political institutions or the economic or social structures of the State, or forcing the public authorities to perform an act or refrain from doing so”. The General Information Police Station, author of the report that has given rise to the opening of the judicial investigation is, in fact, the specialized investigating, among others, the crimes of terrorism in its different variables. The cause is currently under summary secret.

The Government spokeswoman and Minister of Education, Pilar Alegría, has shown this Friday her concern about the massive filtration of confidential information: “Let us think that personal and private data of people hide there, in this case, in addition, people with political and institutional responsibilities, and of course what I hope is that justice investigates and indicates of course those people who are causing this filtration, who are absolutely unforgivable.”
