The Federal Senate (CCJ) began analyzing, this Friday (27), a bill that requires companies to exclude it immediately phones from their databases if the attendant claims not to know the requested person. The bill determines that the refusal to receive the call should be registered at the moment. If the company contacts again, it may receive a warning in the first infraction and then a daily fine ranging from R $ 1,000 to R $ 50 thousand, according to the size of the company, recurrence or systematic non -compliance.

Senator Ana Paula Lobato (PDT-MA) states that “practice is common and abusive, as it exposes the consumer to embarrassment, waste of time and disturbance of tranquility, especially when repeatedly refuses to receive such contacts and remains disturbed.” According to the congressman, the goal is to “protect consumers who receive recurring telemarketing and improper collection calls, directed to unknown third parties.” In her justification, the parliamentarian states that the Consumer Protection Code and the Data Protection Law support her project.

If approved, the text must go to the Senate Transparency, Supervision and Control Committee (CTFC), which will make a terminative decision, ie, will institute the validity without the need to be voted in the House Plenary. Ana Paula Lobato took a seat in the Senate despite not being elected. She held the position after the nomination of Flávio Dino to the Ministry of Justice and, later, to the Supreme Federal Court (STF), which occurred even before he took office as senator. Initially, Ana Paula Lobato was a member of the Brazilian Socialist Party (PSB), however, in April 2024, she chose to join the Democratic Labor Party (PDT).
