By the text, they are considered crimes against people with ASD:
- Practice, induce or incite, by any means (including internet), discrimination or prejudice against autistic person. Pity: imprisonment from 2 to 5 years and fine;
- Injury because of the condition, by any means (including internet). Penalty: imprisonment of 1 to 3 years and fine;
- defam or slander due to the condition by any means (including internet). Penalty: imprisonment from 2 to 4 years and fine;
- threaten by the condition, by any means (including internet). Penalty: imprisonment from 1 to 4 years and fine;
- Disseminate information, images or videos that expose the autistic person to the vexatious or embarrassing situation. Penalty: imprisonment from 2 to 5 years and fine;
- prevent or hinder access to digital services, information or resources. Penalty: imprisonment of 1 to 3 years and fine; and
- Create or participate in online groups that promote hatred, discrimination or violence. Penalty: imprisonment from 2 to 4 years and fine.
Adjustments in the original text
The approved text is a substitutethat is, a new version presented by the rapporteur, deputy (PDT-GO), to Bill 4,426 of 2024, of the deputy (Citizenship-AM).
The rapporteur was favorable to the text and made only adjustments that do not change its main goal. It excluded from the original version the passage that included the discrimination against autistic among the crimes of prejudice by race or color provided for in the law of racism.
The congressman cited a 2023 study of the UK Scope organization, which showed that 29% of people with disabilities reported having suffered online bullying; 53% witnessed negative comments against people with disabilities; and 47% of young adults between 18 and 34 years old were the target of virtual attacks.
