One of Acre’s most award-winning gangs, Junina Pega-Pega, made a public note contesting the penalty imposed by the organizing committee of the 23rd State Juninas Competition.

The group claims that the punishment is based on an appeal by the sassarican junina in the fields which, according to documents presented, is legally invalid.

The source of the penalty lies in the allegation of the opposing gang that the grooms of Pega-Pega did not participate in the traditional “Russian Mountain” step, allegedly breaking the technical parameters of the contest regulation. However, the defense of Junina Pega-Pega argues that the official parameter does not require the participation of all components in this specific step.

For example, they cite the “Great Wheel” step, where the obligation to totality is expressly indicated with the use of the word “all”, something that does not happen in the description of the “roller coaster”.

The strength of the argument of Junina Pega-Pega is reinforced by technical opinions. A PhD teacher in linguistics and an administrative law lawyer issued opinions that point out that the correct interpretation of the regulation does not support the penalty.

“The absence of the linguistic brand of totality (‘all’) in the description of the ‘Russian Mountain’ step prevents any interpretation that obliges the participation of all players,” says an excerpt from the document.

In addition to the interpretative issue of the regulation, the Pick-Page Gang raises serious questions about the formal validity of the appeal that generated the penalty. The document, which was accepted by the organizing committee, was not signed by any representative of the Junina Sassaricano in the fields. For the Pega-Peg, this absence of signature compromises the administrative and legal legitimacy of the appeal, constituting a serious procedural failure by the commission.

Faced with the commission’s refusal to review the decision, even after the reasons for a grounded response, Junina Pega-Pega decided to take the case to the judicial sphere. The goal is to reverse the penalty and to recover the prominent position that, according to them, would guarantee them first place in the overall classification.

“Our presentation fulfilled all the established parameters. There was no infringement. What is, unfortunately, is a mistaken interpretation, added to the acceptance of a document without legal validity. We are not seeking privilege, but only respect for the festival rules,” said one of the gang representatives.
