The Attorney General of the Republic of Argentina (the equivalent of the local prosecutor) requested the court on Monday, 30, that former President Cristina Kirchner will be sent to a federal prison. The request will be tried by the Federal Court of Cassation in the coming days. The former Mottizer has been in the 17th for conviction for corruption.
According to the request, Cristina Kirchner is in an “anomalous” situation because the other eight convicted in the process in which she was considered guilty are arrested in closed regime.
“(This) ends up validating ‘prerogative contrary to equality before the law, which is an improper privilege for Mrs. Fernández over the other convicts in this case,’” says the request of prosecutors, Diego Luciani and Sergio Mola, reproduced by the Argentine newspaper Clarion.

Kirchner was arrested this month to serve the sentence for. She was convicted of being involved in a scheme of overpricing and favoring contracts for public works in the province of Santa Cruz during her presidency. The defense requested that it be placed under house arrest for being over 70 years.
Her lawyers also justified the request because of her attack on her in 2022. She had also asked to have released the need to carry an electronic anklet for not being a risk of escape, a request that the court did not meet.
The Argentine court upheld the house arrest request with the justification that it was difficult to guarantee the full security of a former chief of state in a federal prison.

The former president is serving the sentence in her apartment on Rua San José 1111, in Buenos Aires. Since she was arrested, thousands of supporters have performed acts in the region.
The decision of the judges stated that it should be abstained to “get involved in behaviors that may disturb the tranquility of the neighborhood or disturb the peaceful coexistence of its residents”, in a possible reference to the agglomerations of its supporters. The document does not deal with their appearances on the balcony.
According to the Clarionthe Attorney General’s Office argued on Monday that there are no “real reasons” that justify Cristina’s house arrest. “There has never been real reasons to deviate from what constitutes a clear rule of the Penal Code and the Prison Execution Law: the prison sentence must be served within a penitentiary establishment,” the prosecutors say.

In a previous note, they had already stated that the Ministry of Security, responsible for managing federal arrests, had reported that there were security conditions to receive Cristina Kirchner in one of her offices.
Regarding the age of the former president, the request says that this alone is not justification. “In addition to verifying the requirement of age, it is necessary to prove that the permanence in prison implies the detainee, inhuman, cruel or aggravating their health,” the prosecutors say, in a stretch reproduced by Clarín.
Prosecutors also mention that Cristina Kirchner makes constant attacks on the judges who judged her from a “margin of judicial uncertainty” that house arrest allowed.
