Cade recommends condemning Apple for “anti -specific conduct” involving iOS

The General Superintendency of the Administrative Council for Economic Defense (SG/Cade) recommended on Monday (30) the conviction of Apple for what he called “anti-species conduct” in the Big Tech iOS ecosystem.

The case began in 2022, based on a complaint filed by Ebazar.com and the Free Market, which pointed to “possible abuse of dominant position in the application distribution market for iOS devices,” the agency said in a statement.

The CADE Superintendence added that the investigation revealed a “set of restrictive conduct related to the sale of digital content within the Apple ecosystem.”

Among the restrictions, according to the agency, is the ban on the commercialization of third party digital services and the requirement that developers exclusively use Apple’s payment system in transactions involving digital goods or services.

Cade said he understood that Apple’s conduct configures “violation of the economic order” and recommended the application of fine and behavioral remedies to solve problems, including the termination of investigated practices and the adoption of measures that mitigate their anti -specific effects, with the removal of artificial barriers to entrance.

The agency did not disclose the amount of the fine. The Cade Court will be responsible for the final decision in the case.

In a statement, Apple expressed concern that Cade’s measures undermine users’ experience, as well as representing “new risks to their privacy and security.”

“We will continue to get involved with Cade to defend the rights of user and developers on our platform,” he added.

Cade had already determined preventive measures against Apple last year as part of the investigation.
