O PL (Liberal Party) leader) in the House, Deputy Cavalcante (RJ), criticized decisions of the Supreme Court (STF) and stated that it is the duty of the Court to respect the presidential prerogative of granting indulgers.
The statement was made during participation in TV Cultura’s “Roda Viva” program on Monday night (30).
SOSTENE’s speeches were a answer to the question of Anchor of CNN Brazil, Gustavo Uribewho wondered if it would not be a “naivete” to believe that the Supreme Court would accept a possible presidential pardon or grace to the former President of the Republic, Jair Bolsonaro.
Uribe also asked if it would take any kind of prior dialogue with the Supreme on the subject.
Sostenes stated that the Supreme Court has already interfered with presidential prerogatives at other times and classified these decisions as “improper” citing actions such as when the attempted Jair Bolsonaro attempt to pardon the former deputy, sentenced to eight years and nine months imprisonment due to demonstrations against the Democratic Rule of Law.
He also cited the Supreme Court’s veto when former president of Brazil, Dilma Rousseff, tried to name Lula as minister and when Michel Temer wanted to name Cristiane Brasil, also as minister. For Sostenes, “these consecutive Supreme Courts are undue interference.”
For the parliamentarian, the possibility of a president granting pardon is provided for in the Constitution and must be respected by the judiciary.
“It is the duty of the Supreme Court to respect the Constitution, because it is already planned. The Federal Supreme Court needs to understand this circumstance, which is an attribution of the Presidency of the Republic. We cannot agree with this Faz and undo.”
Sostenes speech comes after Senator Flávio Bolsonaro (PL-RJ) interview with Folha de S.Paulo newspaper, in which he said that if Jair Bolsonaro remains ineligible, he should support a candidate who, if elected, is willing to grant presidential grace to the former president.
Former President Jair Bolsonaro was convicted of abuse of political power and misuse of the media, which made him ineligible until 2030.
