The decision is made by Judge Andréia Nebenzaahl de Oliveira, the 15th Civil Court of the Central Forum of the District of Porto Alegre, the Court of Justice of the State of Rio Grande do Sul. In this Monday’s court ruling, Judge Andréia Nebenzahl de Oliveira makes harsh criticism of the party and states that the absence of the forecast of delegates “demonstrates a persistent and worrying renance on the part of the defendant to comply with the rules established by his own internal normative and, even more serious, to abide by court orders.”
“Allowing such a conference, under these conditions, would be to chance a sequence of null acts and force the plaintiff to a costly and costly dispute to nullify subsequent acts, making the judicial provision innocuous and the process, which has been dragging on for months ineffective,” he writes.
Former Porto Alegre councilman Marcelo Sgarbossa (Rede) defends the suspension of the electoral process. “We want to choose the delegates again, and then we go to a new state conference. In having a new state conference, we can change the quorum of the national,” he says.
“We understand that the network is a necessary party at this time of climate emergency. But we decided to fight because we need a party with the face of Marina, in COP30, with floods in Rio Grande do Sul,” he says.
Sought, the national management of the network said it was not officially notified of the court decision. “Once there is formal communication by the judiciary, the management will evaluate the content of the decision and adopt the appropriate measures, within the legal and statutory parameters,” he says in a statement.

Lamac states that the decision, if confirmed, “is not able to compromise the result of the National Conference, to disappoint these bet on the carpet to change the democratic and legitimate result of the network affiliate votes during the 6th National Party Congress.”
