Judicial reverse for. A federal judge in Washington DC has issued a ruling against the prohibition of asylum applications at the southern border, imposed by the US president last January.
In an extensive ruling, Judge Randolph Moss believes that the Republican’s decision exceeds the presidential powers and violates the US Immigration Law, which allows migrants to request asylum when they are on American soil.
In the document, Moss has indicated that he recognizes the “great challenges” that the Executive faces when “preventing and deter” irregular immigration to the US.
However, he concludes, “neither the Constitution nor the immigration law give the President authority to replace the laws and procedures” already established by the Congress, the judge wrote.
A presidential proclamation, by itself, “cannot affect the right of non -citizens to request asylum, to their eligibility for asylum or asylum procedures,” the judge insisted.
It should be remembered that, suspend the right to asylum and order the immigration authorities “to repel, repatriate or expel” the foreign persons who arrive in the country on this route.
The ruling on Wednesday, against this measure, comes after a group of three organizations, on behalf of 13 asylum seekers, filed a lawsuit against the decree.
This decision adds to other judicial resolutions that have tried to block the agenda of President Trump, focused on fulfilling his promise to deport more than 11 million migrants living in the US without a legal status.
