André Mendonça: ‘STF must rethink about judging crimes’ – 03/07/2025 – Power

With the lawsuit against Bolsonaro and other defendants of the coup plot in the final stretch, the minister stated that the Supreme should “rethink” his competence to “sue and judge crimes”.

According to him, the goal is to ensure that the court fulfills its “most essential” role that is “to be the court of guarantee of fundamental rights”.

The statement was made during the minister’s participation in the panel on “Constitutionality Control and Separation of Powers”, this Thursday (3), at the Lisbon Forum, an event that has Gilmar Mendes as one of the organizers.

In the same panel, the deputy asked to decide on budgetary issues.

Mendonça stated that the judiciary still needs “a reflection on the causes of excessive judicialization” and “a deeper reflection on the list of legitimates to propose an action in the Supreme Court.”

For the minister, “it is possible” that “a crisis is established among powers”, but believes that more worrying is a crisis “before society”.

“Those that there is a discredit of Brazilian society in relation to institutions, we can make ourselves deaf for it or make self -criticism and try to improve for the future, this is the role of democracy,” he said.

At the same event, Mendonça defended an administrative reform in the judiciary that “frames remuneration issues”. Magistrates have to earn well, state agents have to earn properly, but respected the parameters established by the National Congress, “he said.

The minister also stressed that it is also necessary “a safe assessment of the role of each institution” involving the three powers. “Where in this discussion it is not the institutions themselves that have to win or lose, but it is the Brazilian state and the people” who must win.
