The general secretary of the PSOE of Extremadura, Miguel Ángel Gallardo, considers that the Superior Court of Justice of Extremadura has lacked value to judge the open cause against him, the brother of the president of the Government, David Sánchez, and nine other positions of the Diputación de Badajoz. This same Thursday, the Prosecutor’s Office of Extremadura has transmitted the decision not to resort to the Supreme Court the order of the Superior Court of Justice of Extremadura in which he declares his lack of jurisdiction to assume the cause of the Secretary General of the PSOE of Extremadura, Miguel Ángel Gallardo, the brother of the President of the Government, David Sánchez and nine other positions of the Diputación de Badajoz and returns it to the Court of Instruction number 3 of the Capital number 3.

Against the head of that court, Beatriz Biedma, has charged the former president of the Badajoz Diputación, who has spoken of “intentionality” in “not losing the sweetness to be promoted at my expense,” added the general secretary of the regional PSOE.

Gallardo affirms that he respects but does not share the order dictated by the TSJ of Extremadura, since in his opinion it is an “unpublished” decision because, as “prestigious jurists” have been transferred, “it goes against the Statute of Autonomy because the status of deputy is attached to that of Afforado or rather, it is not clusted for anything other than that of being deputy”, he said in his intervention.

From the PSOE of Extremadura it has been maintained since Gallardo’s entry into the assembly was announced that the decision had been made by the party and not the deputy himself, who defends that “it is legal, legitimate and democratic” and considers that it has been made transparently. Gallardo has reiterated that although there are “solid elements” to do so, he has decided not to resort to the car and will be presented to those who cite “with a high head and quiet consciousness.”

The objective, according to the PSOE Extremadura, that Miguel Ángel Gallardo left Badajoz Diputación and entered the Regional Chamber was to confront an alternative region model with the president of the Board, María Guardiola. “To do so, four colleagues had to give up the deputy’s act, but none were put on a gun in the temple, but that they all did it voluntarily, because they belong to an organization that also considers it essential that their secretary general is,” said the general secretary of this party.

Regarding the decision not to resort to this car, Gallardo has asserted that it has been a “personal decision, against even the opinion” of his lawyer, and despite the fact that “there are solid elements, very important legal arguments” to do so.

In addition, he considers that if he resorted to the judicial decision “I would give reasons to those who think that I came here to be ahead”, after which he has reiterated that “never” had that intention: “I always had a goal, that it was to be a parliamentarian, and the objective is achieved,” he said. “By accessing the Extremadura Assembly,” he understood, as established in the Statute of Autonomy, which “has to be the TSJ” that assumes the cause. However, this court decided “in a slightly surprising decision that I can have the status of deputy, but not that of Afforado and, therefore, returns the cause,” Gallardo has detailed.

On the other hand, and given the requests of some parties that he abandons his deputy act, Gallardo considers that the TSJ of Extremadura “gives him the opportunity to be able to demonstrate that what he said was true, therefore, I do not resort to and, of course, I do not resign,” he has reaffirmed.

Finally, the socialist leader has said that in his “freedom of expression” he can talk about judicial resolutions that “seem inappropriate, unfair and that they are against the principle of law”, as well as Judge Biedma “has the freedom to put in her exposition of reasons a series of conditions or a series of intentions of the PSOE, which in no case we have had.”
