Government presents to the STF Plan to reimburse improper discounts of the INSS

The federal government presented on Wednesday (2) to the Federal Supreme Court (STF) a plan to return the amounts improperly discounted from the National Institute of Social Security (INSS) to about 1.5 million retirees and pensioners.

The start of payments is scheduled for July 24, with biweekly transfers, as reported by the Minister of the Attorney General of the Union (AGU), Jorge Messias.

The proposal establishes that, if the associations or unions responsible for discounts do not make the return, the INSS will assume the payment to ensure reimbursement to the beneficiaries.

In addition, those who accept to receive the amount directly from the government will have their individual lawsuit extinct and will give up claims for moral damages related to discounts.

The plan was prepared in conjunction with representatives of AGU, INSS, Ministry of Social Security, Public Defender of the Union, Federal Prosecutor’s Office and Brazilian Bar Association.

The initiative seeks to prevent mass judicialization that, according to official data, grew from about 400 monthly actions in January 2024 to over 15,000 in June 2025.

According to the president of the INSS, Gilberto Waller Júnior, the total amount to be reimbursed exceeds $ 2 billion, referring to discounts made between March 2020 and March 2025.

The government intends to complete payments by October, provided that the schedule is approved by the Supreme Court and the entities involved comply with the deadlines for contestation.

The AGU stressed that the proposed solution aims to ensure full reparation of discounted amounts, while protecting public assets and avoiding even greater financial impact on public accounts.
