The legislative impasse that has been updating the health plans rules in almost 20 years may be close to the end. Federal Deputy Duarte Júnior (PSB-MA) presented 25 amendments to Provisional Measure 1301/2025, which creates the program now has specialists. The parliamentary’s initiative seeks to incorporate into the text fundamental points of Bill 7419/2006, which deals with the reformulation of the supplementary health sector and has been without advancement in the National Congress for over eighteen years.

Duarte took the opportunity to present proposals that increase legal certainty, protect the consumer and guarantee the continuity of care.

End of unilateral termination by operators

Among the main amendments is prohibiting the unilateral termination of contracts by operators. The measure seeks to avoid unexpected cancellations, especially in continuous or emergency treatments contexts. “With this measure, we seek to prevent communication failures or automatic administrative procedures compromise the fundamental right to the health of beneficiaries,” said Duarte. “We want to ensure that the plans fulfill their social function, especially in times of financial vulnerability.”

From the suggested text, the operator may only cancel the contract after two months of default, provided that she has sent periodic communications every twenty days and a notification with acknowledgment of receipt by the fifteen day.

More agile and fair procedures list

Another sensitive point faced by the supplementary health system is the update of the list of procedures and events in health, which defines compulsory treatments by the plans. Duarte proposes a maximum term of 120 days for the analysis, extendable for up to 60 days in justified cases. The proposal aims to ensure agility, predictability and transparency in the process of inclusion of essential treatments, especially for rare diseases often neglected.

Interoperability without discrimination

The deputy also proposed amendment that expands the interoperability of data between public and private health networks, with the objective of improving patient care and systems management. However, it proposes an express ban so that this information is used to restrict adherence to health plans, preventing discrimination by age or pre -existing condition.

Other proposals of the parliamentarian

In addition to the measures already mentioned, Duarte Júnior also suggested:

WARRANTY OF SERVICE AND MONITORING – Obligates operators to maintain minimum standards of service, preventing users from being pressured to seek SUS and then claim reimbursement. There will be continuous monitoring to oversee the quality of service provided. In addition to the limitation of market concentration – to prevent the capture of the R $ 2 billion foreseen in MP by few business groups, the deputy proposes limits of financial participation, ensuring competitive balance and better service to beneficiaries.

Political support and articulation

Although the rapporteur of MP 1301 has not yet been defined, Duarte has already started articulations with Health Minister Alexandre Padilha, and the presidents of the House, and the Senate, so that his proposals are absorbed in the final report. “We are facing a historic opportunity. The program now has specialists can be the gateway to modernize the Brazilian supplementary health system, focusing on patient dignity and sector efficiency,” argues the parliamentarian.

The debate is expected to advance in the coming weeks, with the possibility that part of the reform of health plans will be, finally, approved after almost two decades of waiting.
