The Attorney General of the Union (AGU) manifested on Friday (4) in support of the precautionary decision of Minister Alexandre de Moraes of the Supreme Federal Court (STF), which, as well as the decision of the congress that overturned the measure.
AGU classified the decision as balanced and stressed the importance of dialogue between the powers.
In a statement, Jorge Messias stated that the government welcomes the proposal of conciliation suggested by Moraes, whose hearing is scheduled for next July 15.

According to Messiah, the minister’s order recognizes as “reasonable and plausible” the executive’s argument that there was a violation of the principle of separation of powers.
“AGU values the proposal of interinstitutional dialogue suggested by the Supreme Court, recognizing it as an important space for conflict resolution,” said Messias.
He also stressed, through social networks, that “the fiscal issue is not the sole responsibility of the Executive Power, but a duty of the Brazilian State in its entirety.”

Institutional crisis
Moraes’s decision partially complied with two requests that are being processed in the Supreme in Direct Unconstitutionality Actions (ADIs). One of them was presented by the Liberal Party (PL), which disputes the increase in IOF. The other is authored by PSOL, which questions the overthrow of the measure by Congress.
In the decision, Moraes stated that there are consistent arguments to immediately suspend acts of both the executive and the legislature, justifying that the measure aims to “guide the relations between the powers in the Independence and Harmony binomial.”
The minister also set a five -day period for the federal government to explain why he decided to raise the IOF rates, and for Congress to justify the cancellation of the measure. From these explanations, the Court intends to conduct an audience that can avoid an institutional escalation.
