Hugo Motta (Republicans-PB), president of the House of Representatives, spoke via X (former Twitter) after the Supreme Court (STF) suspension of government and Congress on the IOF and convening a conciliation hearing.

The Supreme Minister, Alexandre de Moraes, who raised the IOF rates as well as the decision of the National Congress last week that sustained the effects of the measure adopted by the government of President Luiz Inacio Lula da Silva.

In an injunction of 24 pages, Moraes calls a conciliation hearing on July 15 with representatives of the government, the House, Senate and the Attorney General’s Office.
Moraes’s decision will pass a referendum from the other ministers of the Supreme.
According to the minister, the clash between the executive and the legislature is “undesirable” and contradicts the independence of powers. He stated that the Constitution does not admit a legislative decree against government decrees that do not regulate a law. He stressed that political parties should have filed the Supreme Court to question the Lula government’s decision to increase the IOF and not to stop the measure through a legislative decree.

On Tuesday, the 1st, the Lula government called the Supreme Court to try to keep the decrees that increased the IOF in force. The decision came from President Luiz Inacio Lula da Silva, after evaluation by the Attorney General of the Union (AGU).
The decrees were overturned by Congress last week, in a defeat by the Lula administration, which had the increase in IOF to cover the break in public accounts.
Jorge Messias, Minister of the Attorney General of the Union, stated that the National Congress could not have “the presidential decree in any way” that alters IOF collection rules. “Considering that the declaratory action of constitutionality aims exactly to preserve integrity, the health of the act practiced by the Chief Executive, the logical conclusion is that this decree would remain valid. Therefore, it could not have been suspended by act of the National Congress,” he said.
