Ministry claims that there are problems in implementing affirmative action policies; Government says it was not judicially notified
The MPF (Federal Public Prosecution Service) requested on Thursday (3.Jul.2025) to the Federal Court of the Federal District the immediate suspension of the 2nd edition of the CNPU (Unified National Public Competition). The 2025 CNU offers 3,652 vacancies distributed in 9 thematic blocks, covering 32 agencies of the Federal Executive Power.
The MPF claims that the event was released on Monday (30.Jun) by MGI (Ministry of Management and Innovation) “without the correction of structural failures pointed out in a public civil action filed a week ago and without adopting measures capable of ensuring the effective compliance of racial quotas in the event. ”
The Public Prosecution Service reports that, on June 25, presented to the TRF1 (Federal Regional Court of the 1st Region) Public Civil Action that points to structural problems of the selection process notice and requested proof of the adoption of measures that correct the failures.
“The immediate suspension of the competition can avoid damage to the effectiveness of the affirmative action policy and quota candidates”says the MPF note.
In this Friday (4.Jul), the AGU (Attorney General of the Union) told the Brazil agencythat “The Union was not summoned by a court decision, nor instated to speak in the case file”. In response to the report’s questions, the Ministry of Management stated in a statement that “It has not yet been notified by the Federal Court of any decision in this case”.
Based on the text of the announcement, prosecutors understand that the rules of the event maintain the same problems already registered in the 1st edition of the contest, in 2024, when several candidates judicially questioned the criteria of certainly for the framing (or negative) as a quotaholder.

Heteroidentification Commissions
The Prosecutor’s Office pointed out that the announcement of the event maintains the guidance that decisions of heteroidentification committees remain definitive. “This contradicts the principles of the contradictory, the broad defense and motivation of administrative acts”says the MPF.
In public tenders, the heteroidentification committee is responsible for verifying the self -declaration of candidates who compete for vacancies reserved for black persons (black and brown).
In January this year, the MPF even recommended the suspension of the disclosure of the final results of the first unified contest of 2024, until the failures in compliance with rules related to racial quotas were remedied.
At the time, the Federal Prosecutor reported that he received complaints from candidates on the application of the evaluation criteria of these commissions. Reports deal with failures in the process of heteroidentification of quota candidates, lack of transparency, difficulties in presenting resources and violation of the right to the contradictory, among other situations.
Even so, the CNU 2024 results disclosure schedule was maintained.
Quota draw
The Federal Public Prosecution Service points out that the draw of vacancies of CNU 2025 for proportional application of racial quotas, in the case of positions with vacancies less than legal minimum, adopted criteria without transparency and lacking external control mechanisms. According to the MPF, this compromises the affirmative action and legal certainty of ethnic-racial quota candidates.
The Ministry of Management held the draw on June 26, with live broadcast on the folder channel on YouTube.
Proportional reserve per dimension
For the Federal Public Prosecution Service, the notice also expresses, expressly, the proportional reserve register by quota modality, which would prevent the monitoring of the convening of candidates until the end of the term of validity of the competition and would weaken compliance with the Legal Reserve.
A-new legislation that deals with ethnic-racial quotas-and the, which deals with quotas for people with disabilities, state that the vacancy reserve only applies automatically when the notice offers:
- Application of the 30% legal reserve for black, brown, indigenous and quilombola people.
- Application of the 5% legal reserve for PCDs.
Rating Lists
Finally, the MPF declares lack of clarity on the advertising of specific classificatory lists and continuous ranking.
